1. Introduction

Quantir, Inc. (“Quantir”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you use our websites, mobile apps, APIs, and related services, including the Tally Estimating Platform, the STEP Process Modules (Scope, Takeoff, Estimate, Proposal), and any other tools or integrations provided by Quantir (collectively, the “Services”).

By using our Services, you agree to this Privacy Policy, our Terms & Conditions, and (for paid subscriptions) our Subscriber Terms. If you do not agree, please do not use the Services.

Our Services are not intended for children under 18. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us at support@checktally.com, and we will delete it promptly.

2. Information We Collect

We collect the following categories of data:

2.1 Personal Data

Information that identifies you or can reasonably be linked to you, such as:

  • Name, company, title, and contact details (email, phone, mailing address)
  • Login credentials (username, password)
  • Payment or billing information (processed via trusted third-party providers)
  • Information you include in estimates, proposals, or uploaded project documents

2.2 Usage & Device Data

Automatically collected data when you use our Services, including:

  • IP address, browser type, device identifiers, and operating system
  • Log data, page views, and referring URLs
  • Session timestamps and feature usage patterns
  • Cookies and analytics identifiers

2.3 Audio & AI Data

If you use our voice-to-text or AI-assisted features, we may collect:

  • Audio recordings and transcriptions (to process your input and improve transcription accuracy)
  • Derived AI outputs, prompts, and feedback data for feature improvement

We use reputable third-party providers (e.g., OpenAI, Google) for transcription and AI processing under strict contractual confidentiality.

2.4 Client or Project Data

When contractors use Tally or the STEP modules to generate estimates or proposals for clients, they may upload or input client information. Contractors are responsible for obtaining all necessary consents before sharing client data with Quantir.

3. How We Use Information

We use the collected information to:

  • Provide, operate, and improve the Services (including AI and pricing integrations)
  • Generate and manage estimates, proposals, and project documentation
  • Process payments and manage subscriptions
  • Communicate updates, technical notices, or promotional messages (with consent)
  • Detect, prevent, and address fraud or misuse
  • Comply with applicable laws and enforce our Terms & Conditions

We process data under lawful bases, including contractual necessity, legitimate interest, and user consent.

For clarity, we process project-related or de-identified information in accordance with our Data Usage Policy, which outlines model training and analytics practices separate from personal data.

4. Data Sharing & Disclosure

We do not sell your personal information.

We may share information as follows:

  • Service Providers: Hosting, analytics, support, payment, and AI providers who act on our behalf under confidentiality agreements.
  • Third-Party Integrations: Optional connections (e.g., accounting, CRM, or material catalogs) that you authorize.
  • Legal Compliance: When required by law, subpoena, or to protect rights, property, or safety.
  • Corporate Changes: If Quantir undergoes a merger, acquisition, or asset sale, data may be transferred subject to this Policy.

5. Voice-to-Text and AI Processing

By using our voice-to-text and AI features, you consent to:

  • The collection and temporary storage of audio for transcription
  • Processing by third-party APIs for transcription or analysis
  • Retention of anonymized transcriptions for model improvement and quality assurance

Retention: Audio recordings are typically retained for up to 12 months unless required longer for feature continuity or legal compliance. You may request deletion by contacting support@checktally.com.

If you do not consent to audio data collection, certain voice-based or AI-enhanced features may be unavailable.

6. Contractor & Client Responsibilities

If you use Quantir’s Services on behalf of clients or third parties, you agree to:

  • Obtain necessary permissions before uploading their information
  • Inform clients about how their data will be processed within the Services
  • Use their information only for legitimate project-related purposes
  • Respond to data requests (access, correction, deletion) under applicable law

You agree to indemnify and hold Quantir harmless for misuse of client data or failure to obtain required consent.

7. Data Security

We implement industry-standard safeguards to protect your data, including:

  • Encryption in transit (TLS/SSL)
  • Access controls and user authentication
  • Data minimization and periodic review of access permissions

Despite our efforts, no system is fully secure. You are responsible for safeguarding your password and device access.

8. Data Retention

We retain personal information for as long as your account is active or as necessary to:

  • Provide the Services
  • Comply with legal obligations
  • Resolve disputes
  • Enforce our agreements

Non-personal or aggregated data may be retained indefinitely.

9. Your Data Rights

Depending on your jurisdiction, you may have rights to:

  • Access, correct, or delete your data
  • Object to or restrict processing
  • Withdraw consent
  • Request data portability

9.1 California Residents (CCPA/CPRA)

  • Deletion of personal information, subject to exceptions
  • Opt-out of data sharing for cross-context behavioral advertising (Quantir does not sell personal data)

We do not discriminate against users who exercise these rights.

9.2 EU/EEA & UK Residents (GDPR)

Where applicable, Quantir acts as a data controller for user accounts and as a data processor for contractor-entered client data. You have rights under Articles 15–22 of the GDPR. The lawful bases for our processing include contractual necessity, legitimate interest, consent, and legal obligation.

10. Cookies & Tracking

We use cookies and similar technologies for authentication, analytics, and personalization. You can control cookies through browser settings, though disabling them may affect site functionality.

11. Data Transfers

Quantir operates primarily in the United States. If you access the Services from outside the U.S., your information may be transferred to and processed in the U.S., where data protection laws may differ. We implement appropriate safeguards (e.g., Standard Contractual Clauses) where required.

12. Communications

By providing your contact information, you consent to receive operational messages about your account, proposals, and updates. You may opt out of promotional communications via unsubscribe links or by contacting us.

SMS Messaging

By opting in to SMS, you consent to receive text messages for account verification, updates, and proposal notifications. You may opt out anytime by replying STOP; reply HELP for assistance. Message and data rates may apply. We do not share mobile numbers for marketing.

13. Changes to This Privacy Policy

We may update this Policy periodically. If we make material changes, we will notify you via email or in-app notice. Updates take effect upon posting the revised version on our website.
